  • Public Notice: ​Proposed Town Wide Official Plan Amendment and Zoning By-law Amendment: Additional Residential Units

    The Town of Newmarket has initiated a Town-wide Official Plan Amendment and Zoning By-law Amendment to implement Provincial legislation and regulation changes regarding Additional Residential Units. 

    Additional Residential Units are separate, self-contained dwelling units with a private entrance, cooking, sleeping, and sanitary facilities, provided for the exclusive use of those residing within the unit. An Additional Residential may be located within the primary dwelling (referred to as an Attached Additional Residential Unit) or within an accessory building or structure (referred to as a Detached Additional Residential Unit) on the same lot as the primary dwelling. 

    The purpose of the Official Plan Amendment is to update the Town of Newmarket’s Official Plan policies to conform to current Provincial policy that allows up to three residential units as-of-right on parcels of land where single-detached, link, semi-detached, and townhouse dwellings are permitted. These units may be configured as follows: 

    Up to one (1) primary dwelling unit and two (2) additional residential units within the primary building; or 

    Up to one (1) primary dwelling unit and one (1) additional residential unit within the primary building and one (1) additional residential unit in a detached ancillary building on the same lot. 

    The Zoning By-law Amendment proposes to amend Zoning By-laws 1979-50, 2010-40, and 2019-06 to implement general zone provisions to regulate Attached and Detached Additional Residential Units. Specific zone standards are also proposed to regulate the location, size, height, and access requirements for Detached Additional Residential Units. 

    Take notice that the Council of the Corporation of the Town of Newmarket will hold an in-person and electronic Public Meeting on: 

     Monday, December 1, 2025 at 1:00 PM 

    The public can attend the meeting in person in Council Chambers at 395 Mulock Drive or view the live stream available at www.newmarket.ca/meetings to consider the proposed Official Plan and Zoning By-law Amendments under Section 17 and Section 34 of the Planning Act.

    Purpose of public meeting: 

    The purpose of the public meeting is to hear from any person who has an interest in the Official Plan Amendment and the Zoning By-law Amendment. On December 1, 2025, Council will not be making a final decision regarding these proposed amendments but will refer all written and verbal comments to Planning Staff to consider and return with a report to a future Committee of the Whole or Council meeting. 

    How to get involved

    The public can attend the meeting in person in Council Chambers at 395 Mulock Drive or the meeting will be streamed live on December 1, 2025 at 1:00 PM at newmarket.ca/meetings. The video will also be made available after the meeting and archived on the Town’s website. If there are any technical difficulties during the live stream, the Town will attempt to post the archived video after the meeting.

    Submit written comments 

    Written comments may be emailed to [email protected]. In order for comments to be received by Council at the statutory public meeting, written comments must be submitted by end of day November 28, 2025. Written comments will also continue to be received after the public meeting has concluded, after the meeting send written comments to [email protected].

    Speak to Council during the live meeting 

    Individuals who wish to provide verbal representation may provide a remote (live) deputation through the Zoom platform during the Council meeting or attend in person in Council Chambers at 395 Mulock Drive. Residents are strongly encouraged to pre-register for a deputation by completing the form provided at newmarket.ca/meetings or by providing their full name and contact information by registering via [email protected] or by calling 905-953-5300 extension 2203. 

    Personal information collected in response to the planning application will be used to assist Town staff and Council to process this application and will be made public. 

    Any person may verbally address Council during the live meeting through Zoom or in-person and/or submit written comments either in support of or against the proposed Official Plan and Zoning By-law Amendments.

    If you wish to be notified of the decision of the proposed Official Plan Amendment and Zoning By-law Amendment, you must make a written request to Planning Services at Town of Newmarket, 395 Mulock Drive, P.O. Box 328, STN MAIN Newmarket, ON L3Y 4X7 or by emailing [email protected].

    If a person or public body, who would otherwise have an ability to appeal the decision of the Council of the Town of Newmarket to the Ontario Land Tribunal, does not make verbal submissions at the public meeting or make written submissions to the Town of Newmarket before the by-laws are passed, the person or public body is not entitled to appeal the decisions of the Town of Newmarket to the Ontario Land Tribunal. 

    If a person or public body does not make verbal submissions at the public meeting, or make written submissions to the Town of Newmarket before the by-laws are passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
